1 INTRODUCTORY PROVISIONS

1.1 These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") are issued by Hybernia, a.s., with its registered office at Prague 1 - Nové Město, Nám. Republiky 3/4, Postal Code 11000, Company ID No.: 26133083, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. B 6255, (hereinafter referred to as the "Operator") as the operator of the Hybernia Theatre (hereinafter referred to as the "Theatre").

1.2 In accordance with the provisions of Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code"), the Terms and Conditions govern the mutual rights and obligations of the Operator as the seller and the spectator as the buyer (hereinafter referred to as the "Audience Member") arising from the purchase agreement concluded between them when purchasing tickets for performances organized by the Operator through the Operator's points of sale (the Theater box office, ticket orders through the Theater's sales department by phone at 221 419 412 or by email at vstupenky@hybernia.eu). In the case of purchasing tickets through the seller colosseumticket.cz, the terms and conditions of this seller shall apply: https://www.colosseumticket.cz/cs/obchodni-podminky.

1.3 The viewer is either a consumer or an entrepreneur. A consumer is a natural person who, outside the scope of their business activities or outside the scope of their independent professional practice, enters into a purchase agreement with the Operator as the seller or otherwise deals with them. An entrepreneur is a person who independently performs a gainful activity on their own account and responsibility in a trade or similar manner with the intention of doing so systematically for the purpose of making a profit. For the purposes of consumer protection, an entrepreneur is also considered to be any person who concludes contracts related to their own business, manufacturing, or similar activities or the independent exercise of their profession, or a person who acts on behalf of or on the account of an entrepreneur. If the Spectator states their identification number in the order, they acknowledge that the Operator considers them to be an entrepreneur.

1.4 By concluding a purchase contract for tickets in the manner specified below, the Viewer confirms that they have read the Terms and Conditions in advance and undertakes to comply with them.

1.5 The provisions of the Terms and Conditions are an integral part of the purchase agreement. Any deviating provisions in the purchase agreement shall take precedence over the provisions of the Terms and Conditions.

1.6 The Operator may amend or supplement the wording of the Terms and Conditions. This provision shall not affect the rights and obligations arising during the period of validity of the previous version of the Terms and Conditions.

2 CONCLUSION OF THE PURCHASE AGREEMENT

2.1 The contractual relationship (conclusion of the purchase agreement) between the Operator and the Spectator arises upon the personal purchase of tickets at the box office at the time of payment and, in the case of purchase through the sales department, upon acceptance of the order.

2.2 The Spectator may also use the option of reserving tickets. Ticket reservations are valid for 7 days from the date of order. In the case of ticket reservations for performances taking place within 14 days of the date of order, the reservation is valid for 3 days. In the case of events taking place within 7 days of the date of order, ticket reservations are possible for 2 days, but no later than 1 day before the date of the event. Ticket reservations are not possible on the day of the event. Reserved tickets must be picked up at the theater box office no later than the last day of the reservation. Unclaimed reservations are automatically canceled and tickets are released back into general sale. In the event of repeated failure to collect reservations (three times or more), the Operator reserves the right to cancel them without notice.

2.3 Email orders are not accepted on the day of the performance.

2.4 Tickets purchased and designated for collection at the Theater box office must be collected no later than 60 minutes before the performance.

2.5 The Operator is not responsible for the inability to collect tickets at the last minute due to the opening hours of the box office or the availability of sales department staff.

2.6 The ticket entitles the Spectator to enter and attend the performance at the time and place stated on the ticket.

2.7 Purchased tickets cannot be returned or exchanged. In accordance with Section 1837(j) of the Civil Code, tickets purchased via email or telephone order cannot be returned.

2.8 It is also not possible to withdraw from the purchase of tickets that were purchased at the Theater box office, regardless of whether this was done on the basis of a prior reservation or not. When purchasing a ticket at the Theater box office, the Spectator is obliged to check the correctness of the information on the ticket, as later complaints will not be taken into account. The Spectator is also obliged to report any claim for discounted admission in advance; later complaints in this regard will not be taken into account.

2.9 The Operator does not provide discounts on admission to holders of ZTP and ZTP/P cards and their companions.

2.10 Discounts on admission prices cannot be combined.

2.11 If the ticket is delivered to the Spectator at a location specified by them, the Spectator is obliged to check the accuracy of the information on the ticket immediately upon receipt, as later complaints will not be taken into account; they are obliged to inform the theater's sales department immediately of any defective performance.

2.12 The Spectator agrees to the use of means of distance communication when concluding a purchase contract (in the case of orders placed by telephone or email). The Spectator shall bear any costs incurred in connection with the use of means of distance communication in connection with the conclusion of the purchase contract.

2.13 The presentation of the Operator's performances on the Internet, on advertising posters, or in other similar presentation materials is for informational purposes only and therefore cannot be considered a proposal to conclude a contract.

3 PRICE AND PAYMENT TERMS

3.1 The price of tickets is governed by the price valid at the time of conclusion of the purchase contract.

3.2 If the Spectator orders a ticket by email or telephone through the Theater's sales department, they are obliged to pay the Operator the purchase price together with the costs of packaging and related costs of delivery to the address specified by the Spectator.

3.3 The Operator is a VAT payer. Unless otherwise stated, the Spectator is obliged to pay the Operator the ticket price including VAT at the rate specified by the relevant legal regulations.

3.4 Unless otherwise specified, the Operator accepts cash or card payments when purchasing tickets at the Theater box office, and payment in advance by bank transfer or invoice if this was agreed when ordering tickets through the Theater's sales department.

3.5 Admission fees will only be refunded in the event of a canceled performance, unless otherwise specified. Tickets can only be returned at the place and in the manner in which they were purchased (at the Theater box office or through the Theater's sales department), unless otherwise specified. Information is provided by the Theater's sales department. In this case, tickets can be returned or exchanged no later than 2 months from the original date of the performance, unless otherwise specified.

3.6 Reimbursement of other costs (e.g., transportation and accommodation of the Spectator at the venue, etc.) is not provided.

3.7 The publication of special promotional offers does not entitle holders of previously purchased tickets to compensation for any price differences.

3.8 Any tampering with the ticket renders it invalid and its holder will not be allowed to enter the Theater. Without the control stub, the ticket is invalid.

3.9 No compensation will be provided for lost tickets. In exceptional cases, it is possible to request a duplicate from the Theater's sales department, which is subject to a fee of CZK 50 per ticket. The issuance of a duplicate is at the sole discretion of the Theater's sales department.

4 CANCELLATION OF PERFORMANCES OR CHANGES TO THE PROGRAM

4.1 The Operator reserves the right to cancel performances, change the program, and/or change the cast (hereinafter referred to as "performance changes"). The Operator shall announce performance changes on its website.

4.2 In the event of a performance change, where a replacement performance is held at the given time, the Spectator's ticket entitles them to attend the replacement performance. If the Spectator is not interested in the replacement performance, they are entitled to withdraw from the purchase contract and will be refunded the ticket price.

4.3 In the event of a performance cancellation, the Operator will refund the ticket price. Together with the announcement of the cancellation of the performance, Spectators may be offered the option of exchanging their ticket for a ticket for another date or performance, a gift voucher for the amount of the admission fee, or another service provided by the Operator.

4.4 Tickets purchased through bulk orders can only be exchanged or returned at the Theater's sales department in the event of a change or cancellation of a performance.

4.5 The spectator acknowledges that in the event of changes or cancellation of a performance, they are not entitled to claim reimbursement of costs incurred in connection with the canceled visit to the performance.

5 PERFORMANCES ORGANIZED BY A PERSON OTHER THAN THE OPERATOR

5.1 The Spectator acknowledges that some performances at the Theater are organized by a person other than the Operator. In such a case, the Operator is not responsible for the quality of the performance, cancellation of the performance, change of program or change of cast, and the Spectator is obliged to assert any claims against the organizer of the performance.

6 FURTHER RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES

6.1 The Spectator acknowledges that during or in connection with the performance, an audiovisual recording of the performance and the Theatre premises may be made. By purchasing a ticket, the Spectator agrees that his or her image may be captured during or in connection with the performance. They also grant the Theater Operator and third parties the right to make and publish any form of recording of the performance or recording in connection with the performance for the theater's marketing purposes. The spectator acknowledges that, pursuant to Section 89 of the Civil Code, a likeness or audio or video recording may be made or used without the consent of the person concerned in a manner appropriate for scientific or artistic purposes and for press, radio, television, or similar reporting.

6.2 The audience is prohibited from making any recordings during the performance.

6.3 The audience acknowledges that the information provided on the Theater's website is for informational purposes only and that the Operator is not responsible for the timeliness, accuracy, completeness, or quality of the information provided.

7 VISITING RULES

7.1 The Terms and Conditions include visitor rules, which the Spectator is obliged to respect in all areas of the Theater. The text of the Visitor Rules is provided in Appendix No. 1 to the Terms and Conditions.

8 EXTRAORDINARY MEASURES

8.1 The Spectator acknowledges that the performance may be affected by extraordinary measures issued by the Government of the Czech Republic or other public authorities in connection with the epidemiological situation, and undertakes to respect the restrictions and fulfill the obligations that will arise for the Operator or the Spectator as a result of the extraordinary measures.

9 OUT-OF-COURT DISPUTE RESOLUTION

9.1 The Operator declares that it is interested in the amicable resolution of any disputes with the Spectator.

9.2 If the Operator and the Spectator fail to reach an amicable resolution of any dispute, the Spectator is entitled to resolve such dispute out of court. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID No.: 00020869, is competent for out-of-court dispute resolution. 10 FINAL PROVISIONS

10.1 The Terms and Conditions are written in the Czech language.

10.2 Any relationships and disputes arising from the purchase agreement shall be resolved exclusively in accordance with the laws of the Czech Republic by the competent courts of the Czech Republic.

10.3 The Terms and Conditions are valid and effective from February 20, 2026, and supersede the previous version of the Terms and Conditions effective from September 28, 2023.
